Terms of ServiceKen Lavigne (owner of 10X Your Voice) maintains this website, any courses offered and other linked and related sites (the “Site”) for

the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the

terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding

agreement between you and Ken Lavigne (owner of 10X Your Voice) If you do not agree to these terms, do not use this Site.
1. Use of Site

Ken Lavigne (owner of 10X Your Voice) provides various materials, information, quizzes, tests, questions, articles, news and other

information on this and related sites and in courses offered through this site (the “Materials”). Ken Lavigne (owner of 10X Your Voice)

authorises each User to view and download (where permitted) one copy of the Materials. Downloadable materials may be

downloaded, and a maximum of one copy of the Materials may be printed/saved provided that Users make no modifications to the

Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials.

Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials

confidential and not sell, auction, loan, rent, give away, describe, summarise, or otherwise reveal the Materials or their contents, to

any other person or entity. Any breach of these Terms of Use automatically terminates your authorised use of the Site.

2. User Warranty

As a User, you warrant that you are not an agent or employee of any other test preparation company and are using the Site and

Materials solely to develop your singing voice.

3. Use License

Permission is granted to temporarily download one copy of any downloadable materials on the 10X YOUR VOICE website for

personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may

not:

1. modify or copy the materials;

2. use the materials for any commercial purpose, or any public display (commercial or non-commercial);

3. attempt to decompile or reverse engineer any software contained on the School’s web site;

4. remove any copyright or other proprietary notations from the materials; or

5. transfer the materials to another person or 'mirror' the materials on any other server.

This license (access to courses) shall automatically terminate if you violate any of these restrictions and may be terminated by Ken

Lavigne (owner of 10X Your Voice) at any time. Upon terminating your viewing of these materials or upon the termination of this

license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

4. "Unlimited Lifetime Access" Conditions

When purchasing a 10X YOUR VOICE product with “Unlimited Lifetime Access,” the User understands that “Unlimited Lifetime

Access” refers to a three-year open-access plan. It is important to note that User accounts are automatically disabled after three

years of non-activity.

Individual accounts will be reactivated for no extra charge if a User wishes to continue using their purchased products beyond the

three-year mark.

Email [email protected] if your account has been deactivated after the three years to have your account reactivated.

'Unlimited Lifetime Access' does not apply to Monthly Subscription plans (See below for more details about Monthly Subscriptions).

Please note that ‘Lifetime’ refers to the product's lifetime and not that of the User. Therefore, should the online platform or the

owner of Ken Lavigne (owner of 10X Your Voice) choose to discontinue the product's supply, then the ‘lifetime’ of the product will be

deemed to have ended. Importantly, all Users will be provided with appropriate notice if the 10X YOUR VOICEOnline Courses were

to be discontinued.

5. 30 Day Money-Back Guarantee

When requested within 30 days of the initial purchase of 10X YOUR VOICE Online Singing Course, 100% of the initial purchase cost

will be refunded subject to the following non-negotiable terms and conditions:

The 30 Day Money-Back Guarantee applies to the 10X YOUR VOICE Online Singing Course ONLY. It does not apply to the Exercise

Collections, Exercise eManuals or any other Ken Lavigne Vocal Coach, product or service. There are no refunds given for digital

products (i.e. mp3 & PDF), apart from what is included in the Voice Essentials 1 Online Singing Course, once they have been

purchased.

FAIR PLAY POLICY: The 30 Day Money-Back Guarantee will NOT be honoured if it is evident that the user has engaged with 40% or

more of the overall 10X YOUR VOICE Online Singing Course content.

It is important to also note that individual results may vary, and that safe and correct vocal development takes time. Therefore

requests for refunds will only be granted once every effort has been made on behalf of the user to engage with the learning

materials in keeping with what is directed within the course materials and complemented by the prescribed practice.

BUNDLE REFUNDS: When purchasing the 10X YOUR VOICE Online Singing Course as a part of a 'single payment' Bundle (e.g. PRO

Bundle), the refund offered will amount to the discounted sale price of the 10X YOUR VOICE Online Singing Course at the time of

purchase .

Please note, once the refund is issued, enrolment is cancelled for the 10X YOUR VOICE Online Singing Course (including audio

exercise tracks and eManual) but is maintained for all other items (including mp3s and PDFs in the other Online Courses)

incorporated in the Bundle package that was purchased.

Refunds are not offered to Users enrolled via the monthly instalments for any course or monthly subscription to Ken Lavigne Vocal

Coach services (See below for more details about Monthly Subscriptions).

After receiving one refund under this policy for an eligible product, any subsequent purchase of the same product by the same

person is not covered under this guarantee. No refunds will be made for such subsequent purchases.

Refunds will be made by the same payment method as the purchase.

6. Monthly Subscriptions

Monthly Subscriptions are not currently offered.

The cancellation of a subscription will be applied at the end of the billing period. After cancelling, Users can still renew subscriptions

until the billing period ends.

8. Trademark and Copyright

Ken Lavigne (owner of 10X Your Voice) and certain other brands, trademarks, and service marks are marks of Ken Lavigne (owner of

10X Your Voice) and its affiliates. The Materials on this Site are copyrighted, and any unauthorised use of any Materials on this Site

may violate copyright, trademark, and other laws.

9. Hyperlinks

Links to external websites are provided solely as a convenience to you. Ken Lavigne (owner of 10X Your Voice) has not reviewed all of

these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of

the external websites linked to this Site, you do so entirely at your own risk.

10. No Warranty

The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability,

fitness for a particular purpose, or non-infringement of intellectual property. Ken Lavigne (owner of 10X Your Voice) further does not

warrant the Materials' accuracy and completeness at this Site. Ken Lavigne (owner of 10X Your Voice) may make changes to the

Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be

out of date, and Ken Lavigne (owner of 10X Your Voice) does not commit to updating the Materials at this Site.

The User engages with the Materials at this site, understanding that results may vary from individual to individual. The User

understands that variabilities such as age, gender, and a User's personal capacity to practice with the Materials provided can all

contribute to the variability of results.

11. Limitation of Liability

In no event will Ken Lavigne (owner of 10X Your Voice), its suppliers, or other third parties mentioned at this Site be liable for any

damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate

information) arising out of use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or

information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not

advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing,

repair or correction of equipment or data, you assume all costs thereof.

12. Applicable Law

The Terms of Use are governed by the laws of the Commonwealth of CANADA. Failure to enforce strict performance of the Terms of

Use of Use shall not be construed as a waiver of any provision or right. Ken Lavigne (owner of 10X Your Voice) may assign its rights

and duties under the Terms of Use without notice to any party at any time.

13. Effective Date and Updates

These Terms of Service are effective as of June 20th 2024, and are subject to change without notice byKen Lavigne (owner of 10X

Your Voice)at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement

to such changes.
